Every human society, however simple or advanced, needs a set of rules. Without law, the strongest people would simply take whatever they wanted, and weaker members of the community could never feel safe. The purpose of law is to replace raw power with justice.

Most laws work by telling citizens what they may not do. A law may forbid theft, or prohibit dangerous driving, and every member of society is expected to obey these rules. In return, the law promises to protect each person equally, no matter how rich or poor.

What happens when someone breaks the law? If a person is believed to have committed a crime, or to have violated an important rule, the police have the power to arrest them. From that moment, however, the accused person still has rights that must be respected.

The heart of the legal system is the trial. In a courtroom, a judge listens carefully as each witness describes what he or she saw. The prosecutor will accuse the defendant, but it is not enough simply to make the accusation; clear evidence is required.

Only when guilt has been proven beyond reasonable doubt can a court declare a person guilty. The court must then decide on a penalty. A small offense may lead to a fine, while a serious crime can send the offender to prison. The aim is to punish wrongdoing fairly.

Why exactly do we punish criminals? This question is endlessly debated. Some believe the main goal is to frighten others away from crime; some believe it is to give victims a sense of justice; and others hope that prison can help an offender change and return to society.

Law does more than respond to crime. Governments also pass rules that regulate business, protect the environment, and restrict actions that might harm the public. Such laws are useless, however, unless the state has the will and the power to enforce them.

No legal system is perfect, and unfair laws have existed throughout history. Yet the basic idea remains precious. By allowing courts, rather than weapons, to resolve our disagreements, the law makes a peaceful and orderly society possible.

いかに単純な、あるいは発達した社会であっても、あらゆる人間社会は一連のルールを必要とする。法がなければ、最も強い人々は欲しいものを何でも奪い取り、共同体の弱い構成員は決して安全だと感じられないだろう。法の目的は、むき出しの力を正義に置き換えることである。ほとんどの法は、市民に何をしてはならないかを告げることによって機能する。法は窃盗を禁じたり、危険な運転を禁止したりすることがあり、社会のすべての構成員はこれらのルールに従うことが期待される。その見返りに、法は、富んでいようと貧しかろうと、一人ひとりを等しく守ると約束する。

誰かが法を破ったとき何が起こるのか。ある人が罪を犯した、あるいは重要な規則に違反したと思われる場合、警察にはその人を逮捕する権限がある。しかしその瞬間からも、被疑者には尊重されなければならない権利がなおある。

合理的な疑いを超えて有罪が証明されて初めて、裁判所はその人を有罪と宣告できる。そのとき裁判所は刑を決定しなければならない。軽い罪は罰金につながることがあり、一方、重大な犯罪は犯人を刑務所へ送りうる。その目的は、不正を公正に罰することである。私たちはいったいなぜ犯罪者を罰するのか。この問いは果てしなく議論される。主たる目的は他者を犯罪から遠ざけるよう恐れさせることだと信じる人もいれば、被害者に正義の感覚を与えることだと信じる人もいる。また、刑務所が犯人を更生させ社会に戻す助けになることを願う人もいる。

法は犯罪に対応する以上のことをする。政府はまた、商業活動を規制し、環境を守り、人々に害を及ぼしうる行為を制限する規則も制定する。しかしそうした法も、国家がそれを施行する意志と力を持たない限り、役に立たない。

完璧な法制度は存在せず、不公正な法は歴史を通じて存在してきた。それでも、その基本的な考えは貴重なものであり続けている。武器ではなく裁判所に争いを解決させることによって、法は平和で秩序ある社会を可能にしているのである。
